What is “excessive bail”?
The Eighth Amendment protects criminal defendants from having excessive bail imposed on them. The meaning of “excessive” is not that well defined. It does not simply mean a bail amount that you cannot afford.

The usual guideline is that bail should be set at an amount reasonably calculated to ensure your future presence in court and ensure the protection of the community. This might end up being an amount that is beyond your means.
However, if it is higher than would be necessary to assure your presence in court, your attorney might be able to argue that it is unconstitutionally excessive.
